By accessing or using SmartFlowCraft ("the Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms apply to all users, including visitors, registered users, and enterprise customers.

2.1 Age Requirement

You must be at least 18 years of age to use SmartFlowCraft. By using the Service, you represent and warrant that you meet this requirement.

2.2 Business Use

If you are using SmartFlowCraft on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case the terms 'you' and 'your' shall refer to that entity.

3.1 Account Creation

To access the Service, you must create an account by providing accurate, complete, and current information. You agree to update this information to keep it accurate.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at info@smartflowcraft.com if you suspect any unauthorized use of your account.

3.3 One Account Per User

Each individual may maintain only one account. Creating multiple accounts to circumvent usage limits or for fraudulent purposes is prohibited and may result in termination.

4.1 Pricing

SmartFlowCraft offers various subscription plans with different features and usage limits. Current pricing is available on our pricing page and is subject to change with 30 days' notice.

4.2 Billing Cycle

Subscriptions are billed monthly or annually in advance. Annual subscriptions are non-refundable except as outlined in Section 4.4.

4.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing cycle unless cancelled at least 24 hours before renewal. You can cancel your subscription at any time from your account settings.

4.4 Refund Policy

Monthly subscriptions may be cancelled at any time but are non-refundable for the current billing period. For annual plans, we offer a 14-day money-back guarantee from the date of initial purchase. After 14 days, annual subscriptions are non-refundable.

4.5 Taxes

Prices do not include applicable taxes. You are responsible for all taxes, duties, and fees associated with your subscription.

5.1 Permitted Use

You may use SmartFlowCraft solely for lawful business purposes in accordance with these Terms and all applicable laws and regulations.

5.2 Prohibited Activities

You agree not to: (a) use the Service to transmit spam, malware, or harmful content; (b) attempt to gain unauthorized access to the platform or other users' accounts; (c) reverse engineer, decompile, or disassemble any part of the Service; (d) resell or sublicense the Service without our written consent; (e) use the Service in any manner that could damage, disable, or overburden our infrastructure; or (f) violate any third-party rights, including intellectual property rights.

5.3 AI Agent Usage

Automated agents and workflows created on SmartFlowCraft must comply with the terms of service of any third-party platforms they interact with (e.g., Gmail, Shopify). You are solely responsible for ensuring your automations comply with applicable laws and third-party policies.

6.1 Our IP

SmartFlowCraft and all related technology, including the platform, AI models, software, interfaces, and documentation, are the exclusive property of SmartFlowCraft, Inc. and are protected by copyright, trademark, and other intellectual property laws.

6.2 Your Content

You retain all ownership rights to the content, data, and workflows you create using SmartFlowCraft. By using the Service, you grant SmartFlowCraft a limited, non-exclusive license to process your content solely for the purpose of providing the Service.

6.3 Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by SmartFlowCraft without restriction or compensation to you.

7.1 Third-Party Services

SmartFlowCraft integrates with various third-party services (e.g., Gmail, Shopify, customer support platforms). Your use of such integrations is subject to those services' own terms of service and privacy policies.

7.2 No Endorsement

We do not endorse or make any representations about third-party services. We are not responsible for the availability, accuracy, or reliability of third-party services.

7.3 API Keys & Credentials

You are responsible for the security of any API keys, tokens, or credentials used to connect third-party services. Compromise of these credentials is not the liability of SmartFlowCraft.

8.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SMARTFLOW AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, BUSINESS, OR GOODWILL.

8.3 Aggregate Liability Cap

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO SMARTFLOW AI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to defend, indemnify, and hold harmless SmartFlowCraft and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

10.1 By You

You may terminate your account at any time by cancelling your subscription and deleting your account from the settings page.

10.2 By Us

We reserve the right to suspend or terminate your account and access to the Service immediately, without notice, if you violate these Terms, engage in fraudulent or abusive behavior, or if required by law.

10.3 Effect of Termination

Upon termination, your right to use the Service immediately ceases. We will retain your data for 30 days after termination, after which it will be deleted in accordance with our Privacy Policy.

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

11.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

11.3 Class Action Waiver

You agree to resolve disputes with SmartFlowCraft on an individual basis and waive any right to bring or participate in a class action lawsuit.

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through a prominent notice in the platform at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
